For hotel payment options, the guest accepts and declares that they will pay the remaining balance in cash or by bank transfer, in domestic tours upon boarding the bus, and in hotel reservations at the time of check-in. ARTICLE-1 SUBJECT

The subject of this agreement is the determination of the rights and obligations of the parties in accordance with the Law on Consumer Protection and the Regulation on Distance Contracts regarding the sale and delivery of the product/service whose characteristics are specified below, in reservation transactions made by the BUYER via the internet site belonging to the SELLER OR PROVIDER electronically or through the call center.

The BUYER accepts and declares under the provisions of this agreement that they have been clearly, understandably, and appropriately informed by the SELLER OR PROVIDER in a manner suitable for the internet environment regarding the name, title, full address, telephone and other contact information of the SELLER OR PROVIDER, the basic characteristics of the product subject to sale, the sales price including taxes, payment method, etc., all preliminary information regarding the product/service subject to sale, the right of withdrawal and how this right may be exercised, and the official authorities to which complaints and objections may be submitted; that they have confirmed this preliminary information electronically and/or by phone or e-mail; and that they subsequently approved the reservation and the agreement.

SELLER OR PROVIDER INFORMATION Title: TCI SEYAHAT VE TAŞIMACILIK SEYAHAT TİCARET LİMİTED ŞİRKETİ (referred to as ITC in the agreement.) Its address and official contact details are clearly stated in the letterhead section.

ARTICLE-2 GENERAL PROVISIONS

2.1 The BUYER declares that they have read and been informed of the characteristics of the product/service subject to the agreement, the sales price and payment method, and all preliminary information regarding the price, and that they have given the necessary confirmation electronically and in the call center system. The full reservation fee is paid at the time of registration. If the full amount is not paid, the reservation is not made. However, if a reservation is made for any reason despite an unpaid balance, the Consumer is responsible for the entire reservation fee from the date of registration. In the event of incomplete payment of the reservation fee, ITC TUR cancels the reservation and claims from the Consumer all damages arising from the cancellation. The Consumer has made the purchase knowing this situation.

2.2 The SELLER OR PROVIDER is liable for defects in the service subject to the agreement.

2.3 If the service subject to the agreement is used by a person other than the BUYER, the SELLER OR PROVIDER is not responsible for that person’s refusal to accept performance.

2.4 For the performance of the service subject to the agreement, the signed copy of this agreement must have been delivered to the SELLER OR PROVIDER and the fee must have been paid by the preferred payment method. Even if the SELLER and/or PROVIDER sends the contract in accordance with the relevant regulation and this agreement, the BUYER who does not sign and send it back cannot claim that the contract is not binding because they did not sign and send it back; all responsibility rests with them, and they are obliged to pay the contract fee in full. It is sufficient that the agreement is sent by the SELLER/PROVIDER to the e-mail address notified by the BUYER; the BUYER cannot claim that the agreement was not sent to them or that they did not read it.

2.5 After the service is performed, if the relevant bank or financial institution does not pay the service fee to the SELLER OR PROVIDER because the BUYER’s credit card was used unjustly or unlawfully by unauthorized persons, the BUYER is responsible for the resulting damages.

2.6 The amounts specified for foreign tours are charges to be collected in the specified foreign currency. The BUYER pays the reservation in the designated foreign currency of the tour price. If payment is to be made in a currency other than the specified foreign currency, payment may be made after conversion at the SELLER’s determined system exchange rate. For reservations with a balance, if remaining payments are to be made in a currency different from the specified currency of the tour, payment must be made at the current system exchange rate determined by the SELLER on the day of payment. There is no exchange-rate fixation in prepaid foreign tours. If remaining payments are made in a different currency, payment must be made at the current system exchange rate on the day of payment.

ARTICLE-3 SERVICES FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

ITC TUR is an intermediary between the service provider and the BUYER. The SERVICE PROVIDER, by virtue of the nature of the service sold by the tour operator, the BUYER does not have the right of withdrawal in distance sales made under this agreement pursuant to the Regulation. The full amount is collected from the BUYER. The BUYER has purchased the service accepting this. Accommodation purchases made during early booking, special periods (New Year, semester break, holidays, etc.) and promotional periods cannot be canceled. However, if the BUYER has purchased the applicable Early Booking Cancellation Assurance Package together with domestic and Cyprus accommodation within the Early Booking period and Summer offers, transactions may be carried out under the conditions stated in Article 10. The BUYER has purchased the service knowingly and accepting this. For reservations purchased at the stated prices with the phrase “non-cancelable,” the Early Booking Cancellation Assurance Package cannot be offered to the guest. In reservations containing this statement, reservation cancellation, change, and refund cannot be made. If transportation (airplane, bus, transfer, etc.) is also purchased in addition to accommodation, transportation fees are non-refundable.

ARTICLE-4 INFORMATION

Pursuant to Article 6 of the Regulation, in reservations made by the BUYER through the relevant website and Call Center, the BUYER is obliged to check and digitally approve, after the sale, the information form containing all details such as date, price, product, concept, etc. related to the selected service during the purchase stage. The SELLER is not responsible for failure to perform the relevant checks and for not giving digital approval. Approvals are recorded electronically.

ARTICLE-5 CANCELLATION - WITHDRAWAL - CHANGES

The SELLER OR PROVIDER may cancel the agreement in cases of force majeure or situations arising from service providers, hotels to be accommodated in, or third parties that prevent the service from starting or continuing, despite exercising all due care. This situation must be notified to the BUYER as soon as possible. In this case, the BUYER has no right to compensation. In such cases, the SELLER OR PROVIDER is obliged to refund to the BUYER the amount it was able to receive from the person or institution from whom/which it purchased or mediated the service. It cannot be held responsible for refunding amounts it could not obtain.

5-1- The BUYER is obliged to notify all kinds of reservation cancellation, change, and addition/removal of persons in writing.

5-2- The travel agency may cancel the trip 24 hours before the departure date if the required number of passengers is not reached for a definite booking or due to force majeure; in this case, the consumer has no right to compensation.

5-3- If the consumer requests cancellation/change up to 30 days before the start of the trip, the full fee shall be refunded in accordance with the package tour regulation.

5-4 If the consumer requests cancellation/change 29-15 days before the start of the trip for a reason other than force majeure, they agree and undertake to pay 30% of the trip fee; if they request cancellation/change 15-7 days before, 50% of the trip fee; and if less than 7 days remain, the full amount to ITC TUR. 5-5 If the consumer requests cancellation/change 29-15 days before the start of the trip for a reason other than force majeure in a foreign tour reservation, they agree and undertake to pay 50% of the trip fee; if less than 15 days remain, the full amount to ITC TUR. There is no right to cancellation, refund, or change for reservations made 7 days or less before the start of the service.

5-6 ITC TUR is not responsible for visa refusal or the visa not being issued in time for foreign tours. In such cases, if the tour is canceled, the cancellation conditions stated in 5-5 apply. It is not possible to refund the visa fee if the visa is not issued on time or is refused.

5-7 If the consumer wishes to cancel the discounted Early Booking Discounted Product purchased during the discounted sales period for any reason and no cancellation assurance package was purchased, the cancellation conditions are taken into account. The consumer agrees and undertakes to pay the full trip fee remaining outside the cancellation conditions to ITC TUR.

5-8 If the consumer wishes to change the date of the discounted early booking product purchased during the discounted sales period for any reason, they accept that a reservation change without discount will be made based on the list prices valid on the date of the request.

5-9 If the consumer requests a date change for the product they have purchased, the change will be made based on the current prices on the date the change is made. The consumer accepts that if there is a price difference between the requested current date and the old date, they will pay the difference.

5-10 In the event of cancellation of the purchased service for any reason, the guest may keep the amount they paid as an open credit. The paid amount is held in the guest’s name as reserved rights. The guest may use the open balance at a different time and on a different tour of their choice. In the processing of reservation and balance hold, the amount paid is used. If, on the date the guest wishes to use their balance, there is a price difference after deducting the reserved balance from the service amount they will receive, the guest accepts to pay the price difference. If they wish to make a reservation for a lower amount, the excess balance remaining after the reservation continues to be held in the guest’s name.

5-11 If the consumer does not notify in writing that they will join the trip they missed at the start later, the travel agency has the right to cancel all reservations made on behalf of the consumer after 24 hours. In such cancellations, no refund is made to the consumer.

5-12 Force majeure: Adverse weather conditions, road obstruction, strikes, terrorism, war, the possibility of war, and unforeseeable technical matters are accepted as force majeure if they prevent the trip from starting or continuing. The deaths of the passenger or their first-degree relatives documented by state authorities are also force majeure.

5-13 The travel agency may, where deemed necessary, partially or fully cancel the tours it has announced or taken reservations for up to 3 days before the start of the trip. Within the same period, it may change the hotel names, means of transportation and their departure points within the trip, and the order of visits to places indicated in the program and shown as places to be visited. If the consumer does not accept these changes and cancellations, they have the right to cancel the reservation and receive a full refund of the amount paid. In this case, the consumer’s right to compensation does not arise.

5-14 In reservation cancellation or change requests made by the consumer, the paid currency and amount will be taken into account. In change requests, the consumer accepts the price difference and exchange-rate difference that will arise on the date the transaction is made. In cancellation and refund transactions, the consumer is refunded in the currency in which the reservation was made and in the amount paid. The consumer has no right to request a refund by comparing with a different currency other than the one paid.

5-15 In refund transactions, the refundable amount is refunded within 7-14 business days according to the payment type used by the consumer. The consumer cannot request a refund in a form different from the payment type used. ITC TUR is not responsible for installment refunds made by banks for credit card payments.

If force majeure prevents the agreement from being performed, the party affected shall immediately notify the other party in writing. If the BUYER requests termination of the agreement due to force majeure, the SELLER OR PROVIDER will make every effort necessary to refund the amount. If the BUYER requests cancellation in the presence of force majeure, the SELLER OR PROVIDER is obliged to refund to the BUYER the amount it was able to receive from the person or institution from whom/which it purchased or mediated the service. It cannot be held responsible for refunding amounts it could not obtain.

6.5 The seller or provider is obliged to perform its obligation within the period it undertook. If the seller or provider fails to fulfill this obligation, the consumer may terminate the agreement. In the event of termination of the agreement, the seller or provider must refund all collected payments to the consumer, together with statutory interest determined under Article 1 of the Law No. 3095 on Legal Interest and Default Interest dated 4.12.1984, within fourteen days from the date the termination notice reaches them, and must return any negotiable instruments and similar documents that impose debt on the consumer, if any. In cases where the performance undertaken by the SELLER/PROVIDER under this agreement becomes impossible, it is obligatory for the seller or provider to notify the consumer in writing or via a durable data carrier within three days from the date they learn of this situation and to refund all collected payments no later than fourteen days from the date of notification.

6.6 Before the contract is established, the consumer’s explicit approval must be obtained separately in order for any additional fee beyond the agreed principal amount arising from the contract obligation to be requested.

6.7 Turkish citizens can enter the TRNC with their Turkish Identity Card. If entry is made with a passport, problems may arise later when entering Greece, so entry with a Turkish Identity Card is recommended.

ARTICLE-7 CONFIDENTIALITY

The information specified in this agreement by the BUYER and the information notified to the SELLER OR PROVIDER for the purpose of payment shall not be shared with third parties by the SELLER OR PROVIDER. The SELLER OR PROVIDER may disclose this information only within the framework of the existence of administrative/legal necessity. Credit card information is absolutely not stored; credit card information is used only during the collection process by being securely transmitted to the relevant banks for authorization and is deleted from the system after authorization. The necessary clarification and information under the Personal Data Protection Law has been provided to the BUYER, and the necessary measures under KVKK have been taken by the SELLER/PROVIDER in accordance with the legislation.

ARTICLE-8 INFORMATION REGARDING PAYMENTS MADE BY BANK CARD

All subsequent transactions occur between the bank and the BUYER; the SELLER OR PROVIDER has no right of intervention or responsibility. Bank rules also apply to refunds related to installment payments, and if payments made in installments are refunded to the card in installments again, the SELLER OR PROVIDER has no obligation or ability to intervene. This matter must be resolved between the bank and the credit card holder.
